Terms of Use of the Online Store and the Privacy Policy

1. GENERAL TERMS

 

1.1. La Ronde Ltd. (hereinafter - "we" or "ELADY.LV") is committed to protecting and respecting your privacy. We do our best to ensure that our processing of personal data complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural entities with regard to the processing of personal data and on the free movement of such data and which repeals Directive 95/ 46/EC (General Data Protection Regulation). By submitting your data, you agree that the data is processed and stored for the entire time of data processing indicated here, as well as in the cases specified in the regulatory acts after the initial data processing for as long as it would be necessary.

 

1.2. ELADY.LV processes your data to ensure the performance of services. It is not possible to provide the service without processing personal data, because according to Article 1404 of the Civil Law of the Republic of Latvia, in every legal transaction, its participants must be taken into account.

1.6. When visiting our online store for the first time, we will ask you to confirm that you agree to the use of cookies under the conditions outlined in this Privacy Policy. The moment you start using the ELADY.LV online store or perform any activities in the said e-store, it will be considered that you are familiar with the e-store rules valid at the time of use and will comply with them.

 

 

1.7 Purposes of using personal data

 

Your name, surname, payer's address, delivery address and contact information (your e-mail address, phone number) Internet store website cookies are processed to ensure service delivery in the Internet store's Customer online system.

1.8 Period of storage of your personal data

The term of personal data storage depends on the type of order. For example, when ordering a product by phone, cookies are saved for no longer than 1 year. Delivering your purchased goods to the payer and/or delivery address you specified, preparing the order for receipt at the place of delivery of the goods and issuing an invoice/delivery note. We will store your data for no longer than 3 years from the date of execution of the transaction. You can at any time express your disagreement about the use of your data by contacting us by e-mail: [email protected] or talking to our employee.

1.9 This section of the Privacy Policy discusses your rights under data protection legislation. Some rights cover many aspects, so we only cover the main ones in this Privacy Policy. We recommend that you familiarize yourself with the relevant legislation and the guidelines of the supervisory authorities in order to know all the information about these rights.

the right to request correction of your personal data that we hold (most of which you can correct by logging into your account);

All disagreements arising from the implementation of these Terms shall be resolved through negotiations. If it is not possible to reach an agreement, the disputes shall be resolved according to the procedure established by the legislation of the Republic of Latvia.

1.10 Registration and Delivery

 

When purchasing Goods in our online store ELADY.LV, the Buyer has the opportunity to register by filling out the registration form at www.elady.lv, specifying the Buyer's personal data: for individuals - name, surname, e-mail address, address where the goods will be delivered, phone number, legal for individuals – name, surname, full name of the company, registration number, address, delivery address, contact information, bank name, bank account number.

The Buyer is responsible for the provided Registration data (for unregistered Buyers - in the Delivery information) being accurate and complete. If the Buyer's data changes, the Buyer must update them before placing the Order. The Seller is not responsible for losses incurred by the Buyer or third parties due to the Buyer providing incorrect or incomplete data (or not changing or supplementing the data).

Availability of products at www.elady.lv is informative, they are updated several times a day. Therefore, there may be a situation that the Product chosen by the Buyer is not/is not available in sufficient quantity. If the Product chosen by the Buyer is not available or not in the required quantity, the manager will contact the Buyer and offer to replace it with an equivalent one or to receive it together with the delivery of new goods.

If the customer does not have a post-payment contract with La Ronde Ltd., the product is delivered only after pre-payment.

The ordered goods can be received at the ELADY.LV office-store for free. If the buyer chooses to receive the goods at the ELADY.LV office-store, the goods will be delivered there within 1-10 working days or depending on the production period, unless a different delivery time is specified for the selected product. The manager of ELADY.LV will notify you by e-mail or by phone. We look forward to receiving your order within 5 working days. After these deadlines, the order will be canceled and the ordered goods will be sent back to the warehouse. The buyer can choose to receive the ordered goods in an OMNIVA package (within 1-2 working days), by courier or at the post office. Goods will be delivered by courier within 1-3 working days.

Important!

Order delivery to the Omniva parcel machine is possible only if the goods do not exceed the specified shipment dimensions (39 x 38 x 64) and weight (up to 30 kg).

 

The seller guarantees the quality of the Goods. The Seller provides a quality guarantee valid for a certain period of time for various types of Goods, the specific term and other conditions of which are specified in the documents submitted together with the Goods. All professional beauty care devices and equipment are guaranteed from 6 months to 3 years (depending on the type of device or equipment).

Product photos are for illustrative purposes only, original products may differ from those shown. The posted product photos cannot be used as a basis for claims. The product is considered appropriate if it corresponds to the sample, model or description provided in the online store.

1.11 Return of goods purchased in the online store

When buying goods on our Internet, the buyer can refuse the goods within 14 calendar days.

Product return policy:

the cost of returning the goods is borne by the customer;

the product must be new (no damage, no signs of wear);

you need to fill out the product return form and contact our manager or send a request to our e-mail [email protected].

A full refund is made within five working days of receiving the returned item. It is also possible to exchange the product for another one, for the same amount, or with a surcharge;

In the event that a manufacturing defect has been detected for the stove, the repair and return of the product to the customer is free of charge. Products with a manufacturing defect can be exchanged or repaired within 20 days of purchase. In the event that the manufacturing defect is not detected, the repair is carried out for a separate fee.

The Buyer shall immediately, but no later than within 14 (fourteen) days after submitting or sending to the Seller a cancellation form or notification of the exercise of the right of cancellation, return or hand over the Goods to the Seller at the office or to a person authorized by the Seller to accept the Goods. The deadline is considered to be met if the Buyer hands over or sends the Goods to the Seller before the end of the 14 (fourteen) day deadline. The buyer bears the cost of returning the Product.

When sending the product back (returning it to the Seller), the Buyer must ensure that its packaging is such that the product cannot be damaged during transportation. In order to avoid possible damage to the packaging, we recommend that you also insure the product when returning it, otherwise the Buyer is responsible for product damage.

The returned Product must not be damaged or used in a way that goes beyond the use of the Product to determine and test its nature, properties and functions. The buyer tries to keep the original packaging, authentic labels and protective bags for the returned Product. Products must be returned complete with the same accessories with which they were sold, together with the Product's instructions and warranty card, if they were delivered with the Product.

Refunds are made using the same means of payment that the customer used in the transaction.

In what case can the right of withdrawal not be exercised?

Clause 22 of the Regulations No. 255 of the Cabinet of Ministers of May 20, 2014 "Regulations on distance contracts" states that the consumer cannot exercise the right of withdrawal if:

The price of the product or service depends on the fluctuations of the financial market, which cannot be controlled by the seller or service provider and which may occur during the right of withdrawal;

The product is perishable or soon to expire;

The consumer has opened the package for a product that cannot be returned due to health and hygiene reasons (for products such as electric toothbrush, epilator, electric shaver, beard/hair trimmer, electric hair clipper, hair straighteners, manicure and pedicure accessories, perfumes, cosmetics, household chemical products and other goods of a similar nature);

Due to its characteristics, the product is irreversibly mixed with other things after delivery;

1.12 Payment procedures and deadlines

 

In any case, the buyer, a private person or a legal entity that does not have a purchase agreement with La Ronde Ltd., can pay for the Goods in the form of prepayment by bank transfer, paying the advance invoice sent electronically by the Seller. The responsibility for data security in such a case lies with the relevant bank, as all monetary operations take place in its system. Either with a bank card or in cash at the ELADY.LV office-store, Riga, A. Čaka Street 64, LV-1011.

After placing the order, the buyer will receive an Order Confirmation to his specified e-mail address to check the specified data again.

The Buyer must pay for the ordered Goods no later than within 3 (three) working days from the receipt of the Order confirmation and/or Advance invoice.

When making payment, it is mandatory to indicate the Order number, which is presented in the order confirmation or advance invoice.

The Buyer can receive the Goods only after the Seller has received payment for the Goods in his bank account.

The Seller has the right unilaterally, without notifying the Buyer, to cancel the order and cancel the Product reservation, if the Buyer has not paid for the Goods within 3 (three) working days after the order confirmation or the date of issuing the Advance invoice. In the event that the payment for the Goods is transferred from a bank other than the Seller's or another state bank, it is recommended to inform the Seller about this by sending a payment order to the Seller's e-mail: [email protected]

The buyer, a legal person who has concluded a purchase contract with SIA La Ronde, makes payment in accordance with the procedure provided for in the contract.

La Ronde Ltd. is not responsible for any kind of expenses and losses incurred during the use of the ELADY.LV online store.

Payments on the website will be made by credit card in full.
